Terms of service
These terms govern your organisation's use of ActivityPulse, provided by Kronosense Technologies L.L.C-FZ. By creating an account or installing the desktop agent, you agree to them.
1. The service
ActivityPulse captures application and window metadata on enrolled Windows and macOS devices, attributes the resulting time to projects and tasks, and makes reports and exports available to authorised users in your organisation. Features available to you depend on your plan.
2. Accounts and access
You are responsible for your account credentials and for the actions taken under them. Access within your organisation is scoped by role; assigning those roles is your responsibility. You must not share credentials or attempt to access another organisation's data.
3. Acceptable use
You must have a lawful basis for monitoring, and where your jurisdiction requires consultation with employee representatives or a works council, you must complete it before deploying the agent. You must inform the people whose devices are enrolled.
You must not use ActivityPulse to monitor people who have not been informed, to circumvent employment or privacy law, to reverse engineer or resell the service, or to interfere with its operation or security.
This is not boilerplate. By default the agent is visible to the person it runs on and capture can be paused, and using the product to monitor people who were never informed is a breach of these terms.
We do not pretend covert monitoring is impossible, because the product supports it in one narrow form and you are entitled to know that before you sign. On the Enterprise plan, outside the EU, an organisation admin can authorise a covert investigation aimed at the whole organisation, one team, or one person. Doing so requires a stated purpose, a DPIA reference and an attestation recorded in your own name; it is capped at 90 days, reverts to visible automatically at expiry, can be ended early, and is written to the audit log on authorisation and on revocation. It suppresses the agent’s on-screen presence only — it never lets the agent collect anything beyond the capture policy you configured.
Covert monitoring is lawful only in narrow circumstances, and whether yours qualify is your assessment as controller, not ours. What we require of you is that the possibility is disclosed in the monitoring notice you give your workforce: unannounced as to timing, never secret as to existence. Authorising covert monitoring of people who were never told it could happen is a breach of these terms.
4. Your data
You retain all rights in the data your organisation puts into or generates through ActivityPulse. We process it as your processor, on your documented instructions, under the data processing agreement. We do not sell it and we do not use captured activity to train machine learning models.
5. Subscriptions and payment
Paid plans are billed per user per month, annually or monthly as selected, in advance. Seat counts are trued up as you add users. Fees are non-refundable except where required by law. We may change prices for a renewal term with reasonable notice before it begins.
The Free plan is provided as-is and may change or be withdrawn with notice.
6. Availability and support
We aim to keep the service available continuously and will give reasonable notice of planned maintenance. A contractual service level is available on the Enterprise plan; other plans are provided without an availability commitment.
7. Termination
You may cancel at any time, effective at the end of the current billing period. We may suspend or terminate for material breach of these terms, with notice and an opportunity to remedy where the breach can be remedied.
On termination you may export your data for thirty days, after which it is deleted along with your organisation's database.
8. Warranties and liability
The service is provided without warranties beyond those that cannot be excluded by law. We are not liable for indirect or consequential loss, or for loss of profit, revenue or data, and our aggregate liability is limited to the fees you paid in the twelve months before the claim.
Nothing here limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud.
9. Governing law
These terms are governed by the laws of the United Arab Emirates, and its courts have exclusive jurisdiction over disputes arising from them.
10. Changes and contact
We may update these terms; material changes will be notified to organisation administrators before they take effect. Questions go to contact@activitypulse.ai.
